Transfer Petition (Both
civil and criminal)
The matters which required to be
transferred from one High Court
Jurisdiction to another High Court’s
jurisdiction i.e. from one state to
another the transfer petition can be
preferred in case there exists a real
jurisdictional issue involving the case.
Alike the SLP other petitions and the
Appeal mentioned herein above before the
Suprme Court requires to have synopsis
and list of dates besides grounds of
Appeal etc.
The matters before the
Supreme Court after the filing goes for
scrutiny and after the objections (if
any) removed the matter is numbered
according to its category. After the
numbering the matter is listed both in
urgent and in normal course of listing.
In case of urgent listing one has to
file the case alongwith the lising
proforma and check list. In case of
urgent mentioning three additional set
of paper books are required to be filed
before the Registrar depending upon its
urgency in the case. In the normal
procedure the cases get listed before
the Supreme Court within one months from
the date of its registration and in case
of urgent listing and mentioning of the
matters the same gets listed next date /
day when the court sits for hearing.
